Commitment description:FGM is widely perceived as a way of controlling female sexuality. Sexual desire in girls and women is viewed as something that needs protection and it is perceived to be a family’s duty to circumcise their daughters to provide this protection . It is also perceived as a way to cleanse a girl from impure thoughts and desires and it enhances woman’s complexion and makes her more devout. Female circumcision seeks to protect a woman’s virginity before marriage by reducing her enjoyment of intercourse and on marriage it is seen to dissuade her from being unfaithful to her husband. In addition to physical harm , psychological and emotional sufferings may affect their lives very badly. It is a form of child abuse as it is done in secret with minors.
Objectives of the Study:To study the circumstances , identify pros and cons, impact on the physical and mental health of girl child and human rights violation.To study and analyze the existing laws to support FGM (justified religious practice) as well as opposing it .To analyze the landmark judicial pronouncements in India and To Compare across the World.To suggest the policy document
In India we have seen practice of Sati amongst Hindus , which was banned by the legislation , if we study the reason why it was prevalent in ancient time was for the protection of those widows. But it was against human rights. Similarly Supreme Court in Shayara Bano’s case held Triple Talaq practice to be declared void as it is against fundamental rights.
Researcher by studying The Medico-legal aspects of FGM will find out the reasons behind this practice , impact of it on the children , who are these people to decide about that 7yr old child to be chaste , her sexual desires. Why , people including parents have to decide, it should be her wish . When we say minors can’t decide on their own how parents chose to decide about her person. It is her life and it has to be protected . Her right to equality, privacy & personal liberty

- Change or creation of legislationCriminalizing FGM will pass strict scrutiny analysis and protect young girls from serious physical and emotional trauma . In India it is a crime punishable under Indian Penal code and Protection of Children from Sexual Offences Act , imprisonment 7yr
- Policy and guidanceIn 2015, the sustainable Development goals were created, FGM elimination was included under Goal 5, to eliminate harmful practices, including child, early and forced marriage & FGM. It is a stark manifestation of gender inequality and discrimination
